By placing an order at www.essenthelabel.com, you warrant that you are at least 16 years old (or have parents’/guardians’ permission to buy from us) and accept these terms & conditions, which shall apply to all orders placed or to be placed at ESSEN for the sale and supply of any products. The personal information you provide will be used to ensure deliveries to you, the credit assessment, to provide offers and information on our catalogue to you. Force Majeure

Events outside ESSEN’s control, which are not reasonably foreseeable, shall be considered force majeure, meaning that ESSEN is released from ESSEN‘s obligations to fulfil contractual agreements. Examples of such events are government action or omission, new or amended legislation, conflict, embargo, fire or flood, sabotage, accident, war, natural disasters, strikes or lack of delivery from suppliers. The force majeure also includes government decisions that affect the market negatively and products, for example, restrictions, warnings, ban, etc.

Payment

All prices for shoes and delivery costs on the website are shown in Australian dollars and include GST or VAT when applicable. Customers can use a debit or credit card for payments on our website. Payments will be processed through our secure payment gateway, Shopify Payments. For further information regarding Braintree, please see further information under our Privacy Policy.

All products remain ESSEN’s property until full payment is made. The price applicable is that set at the date on which you place your order. Shipping costs and payment fees are recognised before confirming the purchase. If you are under 16 years old you must have parents’ permission to buy from ESSEN.

All transfers conducted through ESSEN are handled and transacted through third party dedicated gateways to guarantee your protection. Card information is not stored and all card information is handled over SSL encryption.

Ownership and Risk

Ownership and risk of damage of the goods passes to you upon delivery at your specified delivery address. We require a signature for any goods delivered, at which point responsibility for your purchased goods passes to you. We advise checking to ensure your package is intact when receiving your goods.

If you have specified a recipient who is not you for delivery purposes (for example as a gift) then you accept that evidence of a signature by them (or at that address) is proof of delivery and fulfilment by ESSEN and transfer of responsibility in the same way.

Local Taxes

Please note that local charges (sales tax, customs duty) may occur, depending on your region and local customs duties. These charges are at the customer’s own expense.

Additional Information

ESSEN reserves the right to amend any information, including but not limited to prices, technical specifications, terms of purchase and product offerings without prior notice. At the event of when a product is sold out, ESSEN has the right to cancel the order and refund any amount paid in the best way. ESSEN shall also notify the customer of equivalent replacement products if available.

Discount Codes 

By using or attempting to use a discount code, you agree to accept the following terms and conditions.

• ESSEN has the right to cancel or change any discount code and/or promotion at any time without notice and in its sole discretion.
• Discounts are not valid for cash or cash equivalent. Promotions cannot be applied to previous purchases nor combined with any other offers or discounts including price matching of any other retailer.
• Discounts may not be combined with any other discount codes or offers unless explicitly noted. Qualifying discount amount applies to products only, excluding Gift Cards and shipping, packaging and handling charges (unless otherwise stated).

• 'Excluded Items' means sale items and electronic Gift Cards unless otherwise stated.

By consenting to ESSEN's SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of ESSEN through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using automatic telephone dialing system or other technology. Service-related messages may include updates, alerts and informations (e.g. order updates, account alerts, etc). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders). 

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with ESSEN. your participation in this program is completely voluntary. 

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message freqency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider. 

You may opt-out of the Service at any time. Click the unsubscribe link in any text messages to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by your. If you have subscribed to other ESSEN mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provide in their respective mobile terms.

The wireless carriers supporting by the Service are no liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number. 

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any error in such information, and/or any action you may or may not take in reliance on the information or Service.
